MONCLER 70 YEARS ANNIVERSARY EVENTS



Pursuant to the EU General Data Protection Regulation n. 679/2016 (“GDPR”) and the local applicable laws (together “Privacy Laws”) Industries S.p.A. (“Moncler”), with registered office in Milan, Via Stendhal 47 - Italy, acting as data controller, shall process your personal data, including your image, in line with the applicable laws.

Purposes and legal bases of the processing activities


Moncler will process your personal data for the following purposes and according to the related legal bases:
  • to organize and manage the 70 Years Anniversary Events and the related website (hereafter, collectively, "Events"), enabling you to register to the Events and ensuring access control activities. The processing is based on the compliance with a request from you and on the legitimate interest of Moncler, consisting in the need to ensure access control and correct performance of the Events. In addition, during the Events, Moncler will record videos and take photos that will be posted on Moncler's digital channels (e.g. social media and website) for the purpose of promoting the Events itself. Such activity is not aimed at collecting directly your image, but you may be recorded/photographed as participant to the Events. Therefore, by joining the Events you agree that your data will be processed and your image may be captured during the recording of the Events for the purposes above indicated. In this regard, Moncler will not use your image in contexts that may cause harm to honour, reputation, dignity and respectability, in accordance with applicable laws for the protection of copyright and other related rights. You therefore acknowledge and agree that all the materials produced while photographs are taken and/or videos are shot will remain the full property of Moncler, and you hereby waive any claim in this respect, as well as any claim in respect to the use of your image and you further acknowledge and agree that Moncler has the right of direct or indirect reproduction, temporary or permanent, modification and adaptation, in whole or in part, in any form and means of the photographs, videos and other related materials and copies thereof.
  • with your consent, which is optional and may be collected at the time of your registration to the Events, Moncler may use your personal data for marketing purpose in order to carry out promotional communications, in particular advertising relating to Moncler products and services (including e-mail and newsletter), invites to events relating to Moncler products and services, and market surveys. Promotional communication may be carried out through e-mail, telephone, SMS, MMS, instant messaging, and/or mail. You may always specify your preferred means of contact after you have given your consent and you may always withdraw your consent or opt out of receiving promotional communications through one or all of the communication channels listed above.


Conditions of data processing and retention period


The processing of personal data for the purposes set out above takes place using both automated and non-automated methods, in line with the principles of confidentiality and the security measures prescribed by the Privacy Laws. Personal data will be kept strictly for the time necessary to achieve the purposes for which it is collected, in accordance with applicable Privacy Laws. When Moncler no longer needs to use the data, it will be deleted or properly anonymized so that the data subject can no longer be identified (unless it is necessary to retain the information to comply with any further legal or regulatory obligations to which Moncler is subject). By way of example, for marketing purposes, Moncler will store your personal data for 7 years, in line with the authorization received by the Italian Data Protection Authority.

Third parties


Moncler may disclose your data to third parties such as (i) its employees, duly authorized to process personal data, (ii) data processors, bound to comply with the instructions provided by Moncler through specific data processing agreements, and (iii) partnered companies for the Events. Some of the third parties to whom Moncler discloses personal data may be established outside the European Union ("EU"), in countries which do not ensure an adequate level of protection according to the Privacy Laws. Moncler will adopt all appropriate safeguards to ensure that the transfer of personal data to third countries be adequately protected according to the Privacy Laws (e.g. by signing the EU Standard Contractual Clauses).

Providing your data


Providing your data for the purposes above indicated is not mandatory. However, failure to do so may refrain your possibility to join the Events.

Data subjects' rights


Articles 15-22 of the GDPR give you a number of rights, which you may enforce by contacting Moncler and its DPO as below indicated:
  • request confirmation of the existence or otherwise of personal data concerning you and the origin of such data;
  • request information about the data, the purposes and methods of processing
  • request the cancellation, updating, rectification, integration of data;
  • or request the portability of the data;
  • restrict or object to processing for commercial, advertising or market research purposes;
  • submit requests to the supervisory authority or contact the authority when the exercise of your rights is subject to delay, restriction or exclusion by Moncler;
  • obtain the identification details of data controller and data processors;
  • withdraw your consent, with future effect.
